BREACH OF FIDUCIARY DUTY CLAIMS DISMISSED AGAINST LIFE INSURANCE COMPANY
Daniel Coker Horton & Bell Attorneys, Wilton V. Byars, III and Julia B. Jimenez, successfully obtained Summary Judgment for a life insurance client in a suit involving a substantial claim for life insurance proceeds arising from an ownership dispute and policy lapse complications. The Court found there was no genuine issue of material fact as to the Plaintiffs’ claim of Breach of Fiduciary Duty, that coverage under the life insurance policy ceased on the day the policy lapsed, and that the three-year statute of limitations had expired.
